Occupiers
Liability
Property owners in Ontario must keep their premises reasonably safe. When they fail to do so, people can suffer serious injuries.

If you were injured on unsafe property in Richmond Hill, Barrie, Oshawa, Whitby, Ajax, Pickering, or surrounding Ontario communities, you may have an occupiers’ liability claim and may be entitled to compensation.
At Trianta Law, we represent people who were hurt because a property was not properly maintained or was dangerous.
What Is an Occupiers’ Liability Claim?
You may have an occupiers’ liability claim if you suffered a physical or psychological injury because a property was unsafe.
Common causes include:
-
Slipping and falling on ice or snow
-
Broken sidewalks or uneven concrete
-
Poor lighting or missing warning signs
-
Unsafe stairs or railings
-
Elevator or escalator accidents
-
Collapsing retail shelving or signage
-
Garage or entry door malfunctions
-
Deck or balcony collapses
-

-

-
Property fires
The person legally responsible may be the property owner, the tenant or the business operating on the property.
Your Safety Rights Under Ontario Law
Ontario law requires property occupiers to take reasonable steps to keep you and your belongings safe while you are on the property.
This duty applies whether the danger comes from:
-
The condition of the property, or
-
Activities taking place on the property
If they fail to meet this duty, they may be financially responsible for your injuries and losses.
Important Deadlines for Government Property Claims
Different rules apply if your injury happened on municipal or provincial property.
You must provide written notice within 10 days of the incident.
Examples include:
Municipal property
(sidewalks, roads, curbs, potholes, public pools)
→ Notice must be sent to the City Clerk
Provincial property
(highways, provincial parks, government buildings)
→ Notice must be sent to the Ontario Attorney General
Missing this deadline can seriously affect your ability to pursue a claim, so it is important to get legal advice as soon as possible.
Compensation You May Be Entitled To
If unsafe property caused your injury, you may be able to recover compensation for:
-
Medical and rehabilitation expenses
-
Lost income
-
Future care costs
-
